GENERAL INFORMATION AND TOS

Hello and welcome! I'm BirdyBird-s, digital artist doing some stuff!⋙ I offer both fully rendered illustrations and flat-colored sketches.⋙ Please say more than just "hi, hey, hello". Get straight to the question or point! It makes things faster!⋙ Please try to keep the commission process strictly business. I value my clients, but I do not accept requests for forced friendships, personal information, roleplaying etc. Respect is mutual. Don't get personal. Any hostility or bad behavior will result in the immediate termination of all contacts.⋙ If you are a client (customer), please at first notify me of your intention to publish the work on any external platforms other than FA, DA, Bsky, and X! (Why? I don't like my art to be displayed on other external platforms without discussing and notifying.)⋙ If you're not a client, you're NOT allowed to repost or re-upload any of my work without my strict permission.⋙ I usually open commissions via FA or BlueSky as slots, or as YCHs.

📜 EXTRA TERMS📜

Deadlines & Delivery:
⋙ Timeframe: Standard commissions take 3–5 weeks, with a maximum deadline of 3 months.
⋙ Comics: Projects with multiple pages take 2-4+ months (estimates provided personally).
⋙ Special Events: If you have a specific deadline (e.g., a birthday), please inform me in advance.
⋙ Updates: I provide personal time estimates for every commission and will communicate any potential delays.Final Files:
⋙ I don't keep any files in clouds (Dropbox, etc.) more than for 4 months. Save your files before deleting, I don't have much space.
⋙ High-Resolution: Full-size files (.png/.jpg).
⋙ Web-Ready: Medium-sized watermarked files for social media posting.
⋙ I do not provide .psd files with layers unless specifically agreed upon in advance for valid reasons.Usage & Rights:
⋙ Personal Use: You're welcome to use artwork for personal purposes.
⋙ Credit: I appreciate mentioned only as BirdyBird-s.
⋙ Commercial Terms: Without discussing it's prohibited.⋙ Private Commissions: A fully private commission (never posted by me) costs an additional +100%.
⋙ Anonymity: I can keep you anonymous as a client (posting the work without tagging you) for free!
⋙ I reserve the right to decline your commission or working with you and cease all current or future relations and contacts in all the ways without providing a reason.
⋙ You can't claim any my work, edit, copy or sell it. You can't use works in commercials if other is not agreed and fee is not paid.
⋙ My work MAY NOT be used for AI datasets or NFT.

💸 PAYMENT 💸

⋙ After claiming commission slot, I can wait up to 3 days for the payment. Tell me in advance if you need more time.⋙ I accept ONLY full pre-payment before starting any work: via PP invoice or via Ko-Fi payments.⋙ If you’re not sure and have issues with payment, I’ll help you!⋙ I can't afford you any refunds. Refunds only from my own decision e.x I can't do your work or request.

📜 PROCESS AND CHANGES📜

Important note: your character will be interpreted in my style. Their colors will be influenced by environmental lighting and my style. This means that there won’t be a perfect match with reference colors, bright palettes may appear duller."Work In Progress" (WIP) pictures will be given:Full-rendered type - WIPs are provided at the:
1) Rough sketch;
2) Lines & base colors;
3) (OPTIONAL) background;
4) Finished work.Flat-colored type - WIPs are provided at the:

Revisions are welcome during their respective workflow stages!
⋙ Sketch Phase: Any. Full sketch re-drawings: up to 2.
⋙ Line & Color Phase: Up to 1–5 minor changes are allowed.
⋙ Finished work: Only very minor adjustments can be made; significant changes at this point will incur an extra charge.
⋙ Comics: Revision limits apply to each individual page.Massive amount of revisions and changes might lead to extra charges.Revisions are free if I made a mistake in your character.

By purchasing any adoptable design from me (the artist) through any type of deal or payment, you automatically agree to the Terms of Service below. Do not buy any designs or characters from me if you do not agree with these terms. Breaking any of these rules will result in immediate blacklisting.

✦ I can host auctions and sales across multiple platforms simultaneously.
✦ Ownership goes to the first person to claim or bid on any listed platforms. Please note that the official timestamp on the platform takes precedence over my comment updates!
✦ Only public bids and claims made under my official "Bid here" / "Claim here" comments are valid. I do not accept private bids or buy-outs via DMs.
✦ The design goes to the winner or the person who claimed it first across any of the official public platforms where the sale is held. I must be able to see your comment or bid under the post. Do not hide or delete your comments.
✦ Do not bid or claim if you do not have the funds available.
✦ Auctions typically end 48 hours after the highest bid OR at once if AB is set.
✦ Payment plans and holds are available. Please check the specific post details, as terms depend individually on the pricing set for each design.


✦ Ownership & Usage Rights ✦
✦ Only one person can claim a particular design. Joint or multiple ownership of a single adoptable is not allowed.
✦ Please inform if the purchased adopt is a gift transfer for another user so I can provide proper credit. Future transfers do not require notification!
✦ Only the rightful owner/customer is allowed to use the purchased design.
✦ The buyer receives full ownership rights to the character design, but copyright of the artwork remains with me. Please credit me as the artist.
✦ Only for my adoptables and designs, commercial use (such as using the design for merchandise, games, books, or branding for profit) is allowed, but the owner should let me know about it!
✦ Even as commercial use for adopts is allowed, the owner is not allowed to create closed/open species based on the purchased design.
✦ The owner is allowed to re-sell the character design.


✦ Restrictions & Important Notes ✦
✦ You may not claim credit for the original artwork or copy my designs. Creating heavily inspired, copied or 'twin' standalone characters based on my work is prohibited.
✦ Do not edit or modify my original artwork without my explicit permission.
✦ Any hostility or bad behavior will result in the immediate termination of all contacts.
✦ My work may not be used for AI training, AI generation, or NFT purposes under any circumstances.
✦ I do not offer major design edits or modifications upon the buyer's request.
✦ I do not store files in cloud storage (Google Drive, Dropbox, etc.) for more than 6 months. Please download and save your files as soon as possible!
✦ I do not offer refunds under any circumstances. All sales are final; do not ask to return the design.
